TERMS AND CONDITIONS OF SAILY'S REWARDS PROGRAM

These are the Terms and Conditions of Saily's rewards program (“Program”). By participating in this Program, you agree to these Program Terms and Conditions, which are a binding contract between you and Saily Inc., a corporation organized under the laws of the State of Delaware, United States of America, under registration number 4419800, principal business address 330 N Wabash Ave, Chicago, IL 60611, United States of America (“Saily”), so please read them carefully before entering.
1. Eligibility.
Participation in the Program is open to all individual users of Saily services for personal, non-commercial use.
Participants must be eighteen (18) years or older, or have the legal authority to act on behalf of a valid legal entity. By participating, users represent and warrant that they have full power and authority to enter into and be bound by Saily’s General Terms and Conditions and these Program Terms and Conditions, including all associated obligations, affirmations, representations, and warranties, and to comply with all applicable terms.
The Program may not be available in certain countries or regions, and Saily reserves the right to modify or restrict availability at its sole discretion.
2. Earning Saily Credits.
Rewards under the Program are issued in the form of Saily credits (“Saily Credits”), which may be earned by completing qualifying actions. These actions may include, but are not limited to, activating an eSIM through an eligible plan, referring new users, or purchasing Saily services through a special promotional offer.
The amount of Saily Credits awarded may vary depending on the data plan purchased and/or the specific terms of any ongoing promotions. Full details regarding the amount of Saily Credits, qualifying actions, and applicable promotional rules will be made available on Saily’s website, mobile application, or in associated promotional materials.
Saily Credits are typically issued automatically and added to the user's Saily account within twenty-four (24) hours after the qualifying action has been successfully completed. Users may view their current Saily Credits balance at any time through their Saily account profile.
3. Usage of Earned Saily Credits.
Saily Credits can be applied toward multiple future purchases of Saily data plans on the Saily website or mobile application.
Credits can be accumulated and used to cover up to 100% of an order's value, provided they are used by the same user who earned them.
If the order amount after applying Saily Credits is less than $0.60, users must either: i) cover 100% of the order value using Saily Credits, or ii) cover up to $0.60 of the remaining order amount in payment if they do not have enough Saily Credits in their Saily account to cover the full order.
Saily Credits may not be combined with coupon codes.
Saily Credits are non-transferable and may not be transferred to another user or used outside the Saily mobile application. They may not be redeemed for cash or any other form of monetary value, unless expressly stated otherwise by Saily.
Saily Credits are valid for one (1) year from the date of issuance within the Saily’s account, unless the Program or the Saily’s account is terminated, in which case Saily Credits may be voided immediately.
4. Refunds and Cancellations.
If a refund is issued for a transaction that resulted in the issuance of Saily Credits, and those Saily Credits remain unused at the time of the refund request, such Saily Credits will be voided and removed from the Saily account.
In case of a refund, if the user has already used all or part of the Saily Credits received from the transaction being refunded, the refund amount will be reduced by the value of the used Saily Credits. Saily reserves the right to deduct the equivalent value from the refund or adjust the refund accordingly.
5. Privacy.
Participation in the Program requires the collection and processing of limited personal data, such as earned Saily Credits history, in accordance with our Privacy Policy, that can be found here: https://saily.com/legal/privacy-policy/.
6. Program Modifications and Cancellations.
Saily reserves the right to modify, suspend, or terminate the Program at any time without prior notice.
Saily may modify, suspend, or terminate the Program for various reasons, including but not limited to: i) protecting the integrity of the Program if suspicious or fraudulent activity is detected, such as fake accounts or misuse of the Program; ii) addressing abuse of the Program’s promotional framework, including bulk account creations; iii) suspending or terminating the Program if there are violations of General Terms and/or these Program Terms and Conditions; iv) resolving operational or technical issues that impact the Program's functionality or fairness; v) ensuring compliance with applicable legal and regulatory standards; vi) adjusting the Program in response to changes in business strategy, such as shifting marketing priorities; vii) making necessary adjustments or canceling the Program to maintain fairness and integrity of Saily services.
Changes may include altering the Saily Credits rate, eligible data plans, expiration periods, or other Program mechanics.
Engaging in activities such as purchasing for resale, creating multiple accounts, or multiple checkouts linked to the same individual will lead to the immediate revocation of Saily Credits. Attempts to manipulate or exploit the Program's benefits will result in disqualification and forfeiture of earned Saily Credits.
7. Release and Limitation of Liability.
If the Program cannot operate as intended due to circumstances beyond Saily’s reasonable control, including, but not limited to, technical failures, tampering, unauthorized intervention, fraud, system errors, or any other cause that affects the administration, security, fairness, integrity, or proper functioning of the Program, Saily reserves the right, subject to applicable laws, to disqualify any Saily Credits claims, or to cancel, terminate, modify, or suspend the Program at its sole discretion.
To the fullest extent permitted by law, Saily shall not be held liable for any direct, indirect, incidental, consequential, or special damages, losses, or injuries of any kind arising from or in connection with participation in the Program or the use of Saily Credits, except where liability cannot be excluded under applicable consumer protection laws.
8. Miscellaneous.
Decisions made by Saily regarding any disputes related to the Program are final. No correspondence challenging these decisions will be issued.
9. Governing Law and Dispute Resolution.
The Program is governed by the laws of the State of Delaware, United States of America. Any disputes arising in connection with these Program Terms and Conditions shall be settled by the courts of the State of Delaware, United States of America. Notwithstanding the above, applicable consumer protection laws will still apply for the purpose of protecting consumers.
