Saily Referral Program Terms and Conditions

Introduction
Welcome to the Saily Referral Program (“Program”). These terms and conditions (“Referral Terms”) govern your participation in the Program, which allows Saily users to earn Saily reward credits (“Saily Credits”) and obtain Saily one-time discount (“Referral Code”) that may be used to purchase Saily services.
By joining the Program, participants affirm their agreement to abide by these Referral Terms, designed to ensure fairness and transparency in promoting Saily services.
Participants must be eighteen (18) years or older or have the authority to act on behalf of a valid legal entity, and must have the full rights and power to enter into the Saily’s general terms and conditions (“General Terms”) and Referral Terms, including all conditions, obligations, affirmations, representations, and warranties set forth in General Terms and Referral Terms, and to comply with them.
Program Participation
1. To be eligible, user referring Saily services must be a registered Saily user with an existing account or one created at the initiation of this Program (“Referrer”), and must meet the Program's eligibility requirements.
2. To qualify for the Program, a referred user (“Referred User”) must be new to Saily, meet the Program's eligibility requirements and use special Referral Code (e.g. “DAIN23355”) provided by a Referrer. To receive a discount on the plan, the Referred User must use this code during the checkout process by copying it into the special referral code box during the first purchase of Saily services.
Referral Process
1. Obtaining Referral Code
  Referrers can access their unique Referral Code through their Saily account on the Saily app (“App”).
2. Sharing Referral Code
  Referrers are responsible for sharing their unique Referral Code with potential new users of Saily.
3. Usage of Referral Code by the Referred User
  Referred Users must apply Referral Code at checkout during their first purchase of Saily services.
4. Reward Allocation to the Referrer
  Once the Referred User completes their first transaction using the Referral Code, the Referrer will receive Saily Credits, detailed in their referral reward dashboard (wallet).
5. Reward Allocation to the Referred User
  Once the Referred Users use the Referral Code at the checkout process of their first purchase, the Referred Users will receive a one-time discount of $3 (three USD).
Incentives for Participation
1. Incentives for the Referrer
  1. Rewards Per Referral
    Referrers earn 3 (three) Saily Credits for each successful referral, recorded in their account’s referral reward dashboard (wallet).
  2. Notification of Reward
    Information about successful referrals will be reflected in the Referrer's account within the App.
  3. Usage of Earned Saily Credits
    Saily Credits can be used for the purchasing of any Saily data plan and can be accumulated (up to 100% of the order value), and used across multiple transactions.
    If the order amount after applying Saily Credits is less than $0.50, Referrers must either:
    i) cover 100% of the order value using Saily Credits, or
    ii) cover up to $0.50 of the remaining order amount in payment if they do not have enough Saily Credits in their account to cover the full order.
  4. Restrictions on Saily Credit Usage
    Saily Credits may not be combined with coupon codes, other offers, or promotions.
  5. Saily Credits Removal
    If the Referred User initiates a refund or chargeback, Saily has the unilateral right to remove the Saily Credits (cancel the reward) granted to the Referrer for the canceled data plan from the Referrer’s account.
  6. Non-transferability of Saily Credits
    Saily Credits are assigned to the Referrer’s account and cannot be transferred, exchanged, or redeemed for cash.
  7. Redemption Methods
    Saily Credits can be used through the App or the Website.
  8. Duration of Validity
    Saily Credits are valid for 1 (one) year from the date of issuance within the Referrer’s account, unless the Program and/or Referrer account is terminated, in which case credits may be annulled.
2. Incentives for the Referred User
  1. Application of the Referral Code
    Referred Users must make their first purchase using the Referral Code at checkout in order to receive a one-time discount.
  2. Discount Benefit and Value
    The Referral Code provides a one-time discount of $3 (three USD) applicable only to the first purchase of Saily services.
  3. Usage Restrictions
    The Referral Code cannot be used on Saily data plans priced lower than $3.50.
  4. Non-combinability
    This discount cannot be used with any other coupon codes, promotions, or discounts.
  5. Disqualification
    Saily reserves the right to invalidate any usage of a Referral Code if the Referral Code has been previously used, the benefit has already been redeemed, and/or if the Referral Code is canceled.
Program Modifications and Cancellations
1. Rights of Modification and Cancellation
  Saily reserves the right to modify, suspend, or terminate the Program at any time without prior notice to its existing and potential users.
2. Grounds for Modification or Cancellation
  Saily may modify, suspend, or terminate the Program for various reasons, including but not limited to:
  i) Detecting Suspicious or Fraudulent Activity: Protecting the integrity of the Program if suspicious or fraudulent activity is detected, such as fake accounts or misuse of Referral Codes.
  ii) Abuse of the Promotional Framework: Addressing abuse of the Program’s promotional framework, including self-referrals and bulk account creations.
  iii) Violation of Referral Terms: Suspending or terminating the Program if there are violations of General Terms and/or Referral Terms, such as providing false information.
  iv) Operational and Technical Issues: Resolving operational or technical issues that impact the Program's functionality or fairness.
  v) Compliance with Legal and Regulatory Requirements: Ensuring compliance with applicable legal and regulatory standards.
  vi) Changes in Business Strategy: Adjusting the Program in response to changes in business strategy, such as shifting marketing priorities.
  vii) Ensuring Fairness and Integrity: Making necessary adjustments or canceling the Program to maintain fairness and integrity of Saily services.
3. Actions Against Misuse
  Engaging in activities such as purchasing for resale, creating multiple accounts, or multiple checkouts linked to the same individual or entity will lead to the immediate revocation of Program benefits. Attempts to manipulate or exploit the Program's benefits will result in disqualification and forfeiture of earned rewards.
General Provisions
1. Agreement to Referral Terms
  By joining the Program, participants affirm their agreement to abide by General Terms and Referral Terms, and confirm their understanding of the same.
2. Non-contestability
  Decisions made by Saily regarding any disputes related to the Program are final. No correspondence challenging these decisions will be issued.
3. Conflict
  In case of conflict between General Terms and Referral Terms, General Terms shall prevail over Referral Terms.
4. Verification of Participant Identity
  In cases of dispute over a participant's identity, Saily reserves the right to determine the true identity of the participant.
5. Personal data
  Referrers’ and Referred Users’ personal data will be collected, stored, and processed for the purposes of administering and assessing the Program. 6. Prevailing Language
  For all purposes, the English language version of Referral Terms shall be the original, governing instrument and understanding between participants and Saily. In the event of any conflict between this English language version of Referral Terms and any subsequent translation into any other language, the English language version shall govern and control.
