PHONE NUMBER FUNCTIONALITY - KEY TERMS AND YOUR RIGHTS
Last updated: 2026-06-05
It is a general overview of the main terms applicable to Saily's Phone Number service and your principal rights under the Saily Consumer Terms of Service ("Terms"). The specific commercial details of your purchase - Phone Number and Phone Plan allowances, prices, term and dates - are set out on your receipt and in the offering presented to in the App and/or on the Website at the time of your purchase (the "Offering"). In the event of any conflict between this summary on the one hand and the Terms and the Offering on the other, the Terms and the Offering prevail.
1. General. This is a prepaid travel connectivity service providing temporary mobile access through a dedicated Phone Number for use during travel. You reserve a Phone Number for the destination you are visiting and, where you choose, attach a Phone Plan of voice minutes only, SMS messages only, or a combination of both. Exact allowances, supported destinations or user-base-specific restrictions are set out in the Offering. The service is for personal, non-commercial use. International, roaming, premium-rate, and special-service traffic are not included.
2. Device compatibility. You need an unlocked, eSIM-compatible device. A list of supported devices is available here.
3. Activation prerequisite - identity verification (KYC). Phone numbers are a regulated resource. You must complete an identity-verification ("KYC") procedure, and Saily must successfully verify it, before:
(i) the specific Phone Number allocated to you is disclosed to you, and
(ii) the Phone Number can be used to make or receive calls or SMS, subject to the Phone Plan of your choice.
Until KYC is completed and verified, your number remains hidden and inactive.
4. Activation terms. Phone Number is allocated to your account and the reservation period begins immediately upon purchase confirmation, whether or not you have completed KYC; the reservation period runs independently of KYC and is not paused or extended for KYC delays. Once KYC is completed and verified, an associated Phone Plan activates and you can use the number for two-way communication, subject to the allowances and conditions in the Offering. If you purchase a Phone Plan but do not complete KYC within the specified period, the Phone Plan is automatically cancelled and refunded; your number reservation continues, and you may complete KYC and buy a new Phone Plan before the reservation expires.
5. Fair use. Saily applies fair-use limits and automated anti-fraud and anti-abuse monitoring of traffic patterns, volumes, destinations and costs. Saily may suspend, impose limits, block traffic, require re-verification, or terminate the service where misuse, fraud or non-compliant use is detected.
6. Prohibited use. Any fraudulent, abusive, unlawful or otherwise non-compliant use of the service - as described in the Acceptable use of the Phone Number Functionality (section 3.6.10 of the Terms) is strictly prohibited and is ground for immediate suspension or termination without refund.
7. Coverage and service availability. The service is provided on an "as is" and "as available" basis and relies on underlying telecommunications operators and national numbering authorities not under Saily's exclusive control. Saily does not guarantee uninterrupted or fault-free service, the availability of any specific number, or that calls or SMS (including two-factor-authentication messages) sent by third parties will be delivered.
8. IMPORTANT: Emergency services. This service is not a substitute for traditional telephony and does not provide reliable access to emergency or public-safety services (911, 112, 999 or local equivalents): calls may not connect, may not reach the appropriate local responder, and may not share your location. Always keep an alternative means of contacting emergency services available.
9. Expiration and renewal. Your Phone Number and Phone Plan run for the period selected at purchase. Subscriptions renew automatically at the then-current price unless cancelled before the renewal date; you may cancel auto-renewal at any time in the App, effective at the end of the current period.
10. Number release and quarantine. When your Number Reservation expires, is cancelled, suspended for non-payment, or terminated for any reason, the Phone Number is released into regulatory Quarantine and cannot be re-allocated to you. If you intend to use the Phone Number for two-factor authentication, account recovery, or any other purpose requiring continuous and uninterrupted possession of the same number, you must reserve it for the full intended period and renew before expiry. Saily cannot guarantee continuity in any other circumstance.
11. Refund and cancellation. Refund eligibility is set out in the Refund Policy (section 3.5 of the Terms). In summary: the number reservation fee is non-refundable once the number has been allocated to your account, except where you exercise a mandatory statutory right of withdrawal (KYC not completed and no usage incurred) or Saily cannot provide the service for reasons attributable to Saily; a Phone Plan is fully refundable while not activated and unused, and is automatically cancelled and refunded if you do not complete KYC in time; once a Phone Plan is activated, a full or partial refund may be available depending on how much of your allowance you have used; and no refund is given where suspension or termination results from your breach (e.g., KYC failure, fraudulent use). Refund requests must be submitted within 30 calendar days of purchase for non-subscription products, or within 14 calendar days of purchase or recurring payment for subscription-based products.
12. Your rights, complaints, and dispute resolution. The full Terms are available at https://saily.com/legal/terms-of-service/. For more information regarding Phone Number Functionality please see our detailed FAQ section. For any question or complaint, please contact Saily at [email protected] or through the Saily App. If we are unable to resolve your complaint, you may have the right to refer it to the competent national regulatory or consumer-protection authority and to any applicable alternative dispute resolution body.
13. Privacy and data processing. To provide the service and meet regulatory obligations, Saily processes identity-verification (KYC), traffic, and other data, and may share such data with carrier partners, numbering authorities, regulators and law enforcement where required by law. Full details are in the Privacy Policy.
